Lease cancelation
A student is able to cancel a fixed term lease as long as 20 business days are given in writing. The cancellation is subject to a reasonable cancellation penalty which is normally any damage suffered by a landlord (including lost rental or replacement commission)
The Landlord has already paid the agency to place you as a tenant. You as the tenant are now breaking the lease and a new tenant needs to be placed. You are therefore going to only be charged replacement commission for the remaining portion of the lease as per your lease agreement. It is important to remember that if the unit is not rented out then you will still be liable for rental up to a maximum of four months. We will do our best to try make sure there is no gap in the rental.
You will still be liable for rental up to a maximum number of months outlined in clause 1.29 of your lease agreement
Please note that once you have given the notice to cancel (20 business days) and a vacate date is chosen, you will potentially be liable for further damages should a new tenant be found and you don't vacate the unit as per the agreed date.
